I'm late in replying here, I know, but I would say that this is not an exception to the rule "ignorance of the law is not an excuse," but rather a new rule: "secret laws are not enforceable."
That said, we're getting into the weeds here and I understand (and don't disagree with) the gist of what you're saying.
