Technically, they might sue you if you represent that you are working exclusively for them, which is a clause in most of these contracts. Still, not illegal.

If there is violation of an exclusivity agreement, then I would say it is cheating.

My employers would have a huge problem with the code review rubber stamping and and complete lack of refactoring from me to achieve that.
