I'm all for jumping on the Apple hatewaggon, but I wonder if it
is
completely dead, and it just happened to die while performing an OSX upgrade? Stranger things have happened.

I'm assuming firmware. Assumptions correct, it's BS that Apple won't fix their own mistake.
