If it was the only instance, I'd say sure, but:

- Lindows

- Microwindows

- wxWindows

- Windows Commander

- Suing Amish Shah

- MikeRoweSoft

Then all of the various anti-trust/anti-competition lawsuits against them by both companies and government entities (Be Inc, Nescape, the EU, Spain, the US Government, Caldera, Opera Software. Also individuals in numerous class actions).

Plenty of reason to feel slightly concerned.

Are any of those recent? I agree that microsoft has been pretty dickish and I'm sure parts of it continue to be (see http://bonkersworld.net/organizational-charts as an example for why), but as a whole I feel that they are better with OSS now than they have every been.
